US states and small businesses that won a ruling that most of President Donald Trump’s global tariffs are illegal want them blocked during the administration’s appeal, saying they’re suffering immediate harm from economic uncertainty around the levies.

The Trump administration has asked a U.S. appeals court to block a recent ruling declaring its sweeping tariffs illegal. The White House stated in an emergency motion to the D.C. Circuit Court of Appeals that stopping the tariffs poses a danger to crucial trade talks already underway with dozens of countries.

A trio of judges at the Manhattan-based trade court ruled that Trump’s use of emergency law to impose the tariffs was not legal. The ruling stated the power to regulate trade and commerce lay with Congress and that simply being President did not grant him power to supersede in the name of national security, which Trump had claimed.
